MY ALGARVE RENTALS TERMS AND CONDITIONS

 

We present you the General Terms & Conditions of use of the website; www.myalgarverentals.com, information, elements, data and requirements found therein, and which is owned by the company JACKY REGO FERNANDES with tax identification number 200 450 751, domiciled at: Rua São Sebastião, bloco 4 r/c N – 8400-460 Porches – Portugal, hereinafter abbreviated as “MY ALGARVE RENTALS”.

 

By accessing and using the website, www.myalgarverentals.com , you are expressing your agreement and full acceptance of these terms & conditions. All information contained on this site is intended exclusively for private use, and its use for commercial purposes is prohibited. We inform you that both access and use of the website www.myalgarverentals.com is limited to mainland Portugal and the islands. The privacy of users of the www.myalgarverentals.com website is very important to us. Please consult our privacy policy to find out how we handle and protect your personal data.

 

SPECIFIC CONDITIONS

In addition to these general terms and conditions, there are specific policies relating to some properties, these conditions are, if applicable, duly mentioned on the profile page of each property.

PRE-CHECK-IN

After confirming the reservation of a property, the guest will receive an email from My Algarve Rentals with the confirmation of the reservation and with important explanations about the property they have just booked. The guest will be invited to fill in a Pre-Check-In form which is very important for us to provide the best possible service. The Pre-Check-in form will ask for the arrival time and the total number of people staying at the property so that we can provide the right amount of bed linen and bath towels. The pre-check-in form will also indicate the useful and important information for the reception of the property key that will be hand delivered by a company employee. All check-ins are in person, and in some cases, there may be non-face-to-face check-ins in which the property access codes will be sent to the guest in advance.

When booking, the guest can also book additional services, namely, “early check-ins, late check-outs, cribs, highchairs for babies, among other services. Additional services will only be provided when they are duly ordered and paid for through www.myalgarverentals.com. My Algarve Rentals cannot assume any responsibility if the guest does not complete the Pre-Check-In form. All information provided to My Algarve Rentals in the Pre-Check-in form (for example, check-in and check-out dates, among others) is stored in our database. Any attempt to alter and/or violate the original information will invalidate the pre-check-in form and be subject to cancellation of the reservation.

ARRIVAL AND CHECK-IN

Unless otherwise agreed, all check-ins are in person at the property and always from 16:00 until 23:00. There is, however, a supplement for late check-ins from 7pm to 10pm have a fee of 25 euros and from 10pm the fee is 45 euros. 

The guest must call the telephone number previously indicated at least 45 minutes before arriving at the property so that one of our employees can be on site and welcome the guest. All contacts will be provided after booking confirmation. We cannot assume any responsibility if the guest does not call-in advance.

PAYMENTS

Any outstanding payment must be made on arrival. My Algarve Rentals reserves the right to cancel the reservation if the guest refuses to pay the amount due at check-in. Payments for entries after the stipulated time must be paid in cash, preferably at check-in. For guests arriving before check-in time (16:00h) My Algarve Rentals cannot and does not have the conditions or logistics to store its guests' luggage.

PROPERTY KEYS

Upon check-in, My Algarve Rentals only provides one or two set of keys. Guests must be careful not to lose it or leave it inside the property. Additional fees will apply for lost keys or lockouts. Fees are charged as follows:

Lost Keys (price per key) - 30 euros - Emergency visit (between 9 am and 11 pm) - 35 euros - Emergency visit (between 11pm and 9am) - 90 euros. 

In case the company must hire a locksmith service, the guest will be responsible for the total amount charged by the service provider. The service provider fee is based on complexity, materials, time spent and other variables. Please be advised that it can take up to 60 minutes for our staff to arrive to assess the situation and take action. Guests must return all keys upon check-out.

APPLIANCES AND PROPERTY AMENITIES

All appliances and amenities at the property are described on the property page. My Algarve Rentals cannot supply any items that are not listed (eg air conditioning, heaters, television).

MAINTENANCE AND SPECIAL ORDERS

Any and all problems within the property (eg electrical problems, equipment malfunctions, water leaks) must be immediately reported to our customer service via email or telephone. Depending on the issue, resolution can take up to 72 hours, or longer if relying on third-party services. While respecting guests' privacy, My Algarve Rentals reserves the right to access the property at any time, if necessary, for inspections, repairs, and emergencies. Cots for babies can be requested, in advance, but are limited to availability at the time and always subject to an additional payment to be paid upon delivery of the equipment.

DEPOSIT

A deposit of 300 euros is required upon arrival, which can be left in cash, bank transfer or PayPal. The deposit will be returned within 7 days by bank transfer or PayPal in the bank account to be indicated by the guest and always after complete cleaning and verification of the accommodation.

APPLIANCES AND/OR EQUIPMENT

If an appliance does not work, or if guests are unsure how to use any equipment in the house, they should contact the My Algarve Rentals team.

CLEANING

The property will be cleaned prior to guest arrival. My Algarve Rentals' basic service includes a set of towels, bed linen and some toiletries for each booking. Additional cleaning services and products, including linen and towel changes, are available for an additional fee. Guests are not required to clean the property upon check-out but should nevertheless keep it as tidy as possible upon check-out. Please do not leave garbage outside the property door or outside the building door. Use the trash bins on the street intended for this purpose.

PETS

No pets (of any breed, size, or age) are allowed on My Algarve Rentals properties. My Algarve Rentals reserves the right to require guests to leave the property without any compensation or refund of fees paid if any animals are found inside the property.

SMOKING

Smoking is strictly prohibited in all properties that My Algarve Rentals manages and administers. This includes all balconies, patios, terraces, and garden areas. Any traces of cigarette smoke or similar will incur an additional fee of 100 euros.

FURNITURE

Guests may not make any changes or additions to the accommodation or its contents.

ITEMS ON THE PROPERTY

All items found on the property belong to the owner and must not be moved or removed from the property during the stay. Noise Law: Between 22:00 and 8:00, please keep all noise to a minimum. Please do not disturb neighbors when opening or closing the property door or building door. We do not accept reservations for illegal or immoral activities. The guest whose name is on the booking confirmation email will be responsible for the behavior of the entire group and agrees to avoid any and all illegal activity. You must not invade the owner's privacy or publish anything that could allow third parties to identify the property's address or the owner's identity (even if such information is already in the public domain). Guests are primarily responsible for their own safety during their stay with My Algarve Rentals. Guests must listen to any instructions or explanations provided by My Algarve Rentals during check-in. If a guest becomes aware of anything during their stay that they believe to be a health and safety risk, they should immediately inform My Algarve Rentals. When leaving the property, guests must make sure that they leave the gas appliances turned off, windows closed, air conditioning, central heating and lights turned off.

CHECK-OUT

Check-out is until 10:00 am and all guests must leave the property at the time indicated, not being able to leave any of their belongings under any circumstances. Guests must inform the desired check-out time so that a My Algarve Rentals employee can be present at check-out. If the My Algarve Rentals employee cannot be present at the time of checkout, the guest can and should leave the keys on the main table, inside the property and slam the door, ensuring that it cannot be opened. Guest must NOT leave keys in the door lock. Guests who do not leave by 10:00 am may be charged an additional half-day accommodation fee. If the guest refuses to leave, My Algarve Rentals reserves the right to enter the property, remove their belongings, change the locks and also take other measures that may be necessary. (The guest will charge the costs of any such action).

ITEMS LEFT ON THE PROPERTY

My Algarve Rentals is not responsible for any items left inside the property after the guest has checked out. Any belongings found on the property can be returned on request. The guest is fully responsible for all expenses related to the process of returning their belongings. If My Algarve Rentals finds a property, it will be kept for 30 days from the date of departure of the guest. After this date, the belonging can be handed over to a charity or similar institution.

NUMBER OF GUESTS

Guests must indicate the exact number of people on the pre-check-in form. The number of guests specified in the reservation cannot exceed the number of guests specified in the accommodation. If the number of guests exceeds the limit, My Algarve Rentals reserves the right to require guests to leave the property without any compensation or refund of fees paid.

PROPERTY DAMAGE

Guests agree to pay the cost of any damage to the accommodation or contents. The guest authorizes My Algarve Rentals to charge such fees to the credit or debit card provided during the booking.

RESPONSIBILITIES

My Algarve Rentals service is legally limited to properties and the relationship with guests during their stay. My Algarve Rentals will not be responsible for any occurrences outside the property's boundaries, such as (but not limited to): cleaning and maintenance of the building, exterior noise, construction, neighbors, or any other matter not directly related to the property itself. Photos and property descriptions are produced by My Algarve Rentals or a third party at the request of My Algarve Rentals and have been reviewed by the owners. Minor changes to the property may occur in relation to the photos on the website, without compromising its general condition or amenities. My Algarve Rentals will not be able to compensate guests, refund fees, or transfer guests to other properties based on the appearance of the property or surroundings. It is the guests' responsibility to ensure, prior to booking, that the area or neighborhood they choose to stay in is to their liking. My Algarve Rentals is not responsible for any damages caused, directly or indirectly, that may occur during the guests' stay at the property, such as (but not limited to): personal injury, theft or criminal behavior, losses due to fire or misconduct, etc. The same applies in relation to any deficiencies in the supply of gas, electricity, water, telephone, or internet. My Algarve Rentals is not responsible for potential delays, accidents, losses or changes in schedules or rates that are related to the services of our suppliers. My Algarve Rentals is not responsible for errors and/or omissions, false statements by third parties, disputes between a guest and a third party, or for the content of external links other than the one on which the reservation was made. In the event that guests do not comply with these terms and conditions, or in case of misbehavior on the part of guests, My Algarve Rentals reserves the right to require them to leave the property without any compensation or refund of fees paid.

UNUSUAL SITUATIONS AND LEGISLATION

This agreement is between the guest and the company My Algarve Rentals, which is duly authorized to arrange the rental of the accommodation. This agreement is a license to occupy the accommodation for the agreed period. The guest is not a tenant of the accommodation and does not have exclusive possession of it. In the rare event that a reserved property becomes unavailable, due to damage caused by a water leak, for example, or by any circumstance beyond our control, My Algarve Rentals will not be responsible for any inconvenience caused, however we will take all measures necessary to move the guest to a property with similar characteristics. If the guest does not accept the change, the full amount (excluding costs related to the days the property was used by the guest, if applicable) will be refunded, but neither the owner nor My Algarve Rentals will be liable to the guest for any additional value in relation to the cancellation of the reservation. My Algarve Rentals will not be responsible for the possible theft of objects left on the property.

PROPERTY DAMAGE

Guests must notify My Algarve Rentals of any damage to the accommodation, contents, equipment or accessories that occurs during their stay, even if the guest considers the damage to be regular wear and tear and not their fault. If the guest does not notify My Algarve Rentals of such damages, they will be held liable for them. Any deductions for property damage will be charged to the credit or debit card the guest has provided. The guest authorizes My Algarve Rentals to charge such fees to the credit or debit card provided during the booking. The guest acknowledges that the accommodation is a house and agrees not to access any locker or drawer that has been sealed and also agrees to pay a flat fee as set out in the house rules for any breach of such seal.

ABOUT THE TERMS AND CONDITIONS

My Algarve Rentals reserves the right to update its terms and conditions at any time as necessary. It is the responsibility of the parties using the My Algarve Rentals service to review these terms and conditions in the event of a change before making a booking. By agreeing to use the My Algarve Rentals service, it is understood that the guest accepts any changes and that all parties will comply with these changes. These terms and conditions do not affect guest rights.

CANCELLATION

To cancel a reservation, the client must contact My Algarve Rentals as soon as possible by email, quoting the reference number of his reservation. Any cancellation may be subject to payment of cancellation fees. Depending on the reasons for their cancellation, the customer may be able to recover these cancellation fees from their insurance company, if they have taken out travel insurance. We strongly recommend that all customers obtain adequate personal and travel insurance coverage.

CANCELLATION POLICY AND FEES

Cancellation policy may vary. If for any reason the customer wishes to change their booking (for example, change the dates of their stay or even the property), My Algarve Rentals will do their best to respond appropriately to the customer and fulfill their request, but no guarantee can be given. If no suitable alternative is available, the cancellation policy will apply.

FORCE MAJEURE

The short-term rental offer of properties is a “grey area” and there is some risk that authorities may close or prevent access to properties listed on this website. All property rentals on this website are subject to the local laws and legal conventions of the country of origin of the company managing the accommodation in question.

APPLICABLE LAW

These conditions are subject to Portuguese law. The Portuguese Courts have exclusive jurisdiction in the event of legal action relating to any accommodation reservation with My Algarve Rentals.
